By accessing outband.io or using the Outband software, you agree to these Terms of Service. If you are using the software on behalf of an organization, you represent that you have authority to bind that organization to these terms.
The Outband open source software is licensed under the Apache License 2.0. Your use of the open source software is governed by that license, not these terms. These Terms of Service govern your use of the outband.io website and any paid enterprise services.
Enterprise customers receive access to the enterprise binary, CLI tools, a license key, email support, and software updates during the license term. Enterprise services are provided on a monthly or annual subscription basis with payment due net-30 from invoice date.
Enterprise services do not include a service level agreement (SLA) unless the customer is on the Enterprise Plus tier, in which case the SLA terms are specified in the Commercial License Agreement.
Performance warranty terms for enterprise services are defined in the Commercial License Agreement.
Either party may terminate an enterprise subscription with 30 days written notice. Upon termination, the license key is deactivated and enterprise features become unavailable. The customer retains all evidence files, telemetry data, and reports generated during the license term. The open source software continues to function without limitation.

To the maximum extent permitted by applicable law, Outband shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of cause of action or theory of liability. Outband's total aggregate liability shall not exceed the fees paid by the customer in the twelve (12) months preceding the claim.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
We may update these terms from time to time. Material changes will be communicated via the website or email to enterprise customers. Continued use of the website or services after changes constitutes acceptance of the updated terms.
